Direct application and enforcement of the HIPAA regulations to business associates and their subcontractors for regulatory violations;
The new, lower threshold for what constitutes a reportable “breach” of unsecured (i.e., unencrypted) PHI and associated breach notification standards for covered entities and their business associates;
Covered entity liability for the actions of their business associates;
Required modifications to business associate agreements; and
Hybrid entity status; including restrictions on designation of “internal” business associates.
