The webinar will concentrate on a number of key changes to the HIPAA Privacy, Security, and Enforcement Rules, including:

  • Issues concerning “marketing” with a focus on the new rule’s requirements for “authorization” for communications where the covered entity receives financial remuneration for making the communications from a third party whose product or service is being promoted.

    • HHS’s maintenance of the “face-to-face” exception.

    • HHS’s implementation of the HITECH Act’s “refill reminder” exception:

    • Types of qualifying messages; and

    • What constitutes “reasonable compensation.”

  • Operational issues such as:

    • Direct application and enforcement of the HIPAA regulations to business associates and their subcontractors for regulatory violations;

    • The new, lower threshold for what constitutes a reportable “breach” of unsecured (i.e., unencrypted) PHI and associated breach notification standards for covered entities and their business associates;

    • Covered entity liability for the actions of their business associates;

    • Required modifications to business associate agreements; and

    • Hybrid entity status; including restrictions on designation of “internal” business associates.
