On April 6, 2011, the Food and Drug Administration issued a proposed rule requiring nutrition labeling of menu items in restaurants and "similar retail food establishments" -- including supermarkets. The rule implements the menu labeling requirements included in the Patient Protection and Affordable Care Act (P.L. 111-148). The rule as drafted has very broad implications for the supermarket industry. FDA is proposing to apply the menu labeling requirements to virtually every item in the store that is not already required to have a nutrition label.
