On December 15, 2010, the Environmental Protection Agency (EPA or Agency) published in the Federal Register for comment a proposed rule which would amend the leak repair regulations promulgated under Section 608 of the Clean Air Act Amendments of 1990 (the “Proposed Rule).1 The Proposed Rule lowers the leak repair trigger rates, changes certain definitions and imposes a new follow-up verification test and three strike rule for commercial refrigeration and comfort cooling appliances among other things.
