On February 5, 2014, the Food and Drug Administration (FDA or the Agency) published in the Federal Register a proposed rule entitled Sanitary Transportation of Human and Animal Food (“Proposed Rule”).1 The Proposed Rule establishes requirements for shippers, carriers by motor vehicle and rail vehicle, and receivers engaged in the transportation of food, including food for animals, to use sanitary food transportation practices to ensure the safety of the food they transport. The Proposed Rule is being issued to implement the Sanitary Food Transportation Act (SFTA) as required by the Food Safety Modernization Act (FSMA).
